  • Data Processor: Apps Leisure Ltd acts as the Data Processor, processing personal data on behalf of the Data Controller (the business) solely for the purposes of providing the platform services. We process data only in accordance with the Data Controller’s instructions and in compliance with these terms and our Data Processing Addendum (see Section 18).

13. Data Retention

We collect only the information necessary to provide our online services to sports business owners and their members. Your information will be retained only for as long as is required for our legitimate business purposes and in compliance with any legal obligations regarding data retention.

Retention Period After Account Closure: Following the closure or cancellation of your business account, all personal data associated with your account and the accounts of your members will be retained for a period of 60 days. This retention period allows for account recovery should you change your mind. After the 60-day period, all data will be permanently and irreversibly deleted from our systems, including all backups and archives.

Active Accounts: For active accounts, we retain personal data for the duration of the contractual relationship and in accordance with our lawful bases for processing. We periodically review the data we hold to ensure it remains necessary and proportionate.

Occasionally, we may need to transfer your information to third-party service providers that assist Apps Leisure in delivering our services. This will only be done under strict confidentiality agreements, ensuring that your private information is protected and used solely for the agreed-upon purposes.

As a business owner, you have the right to update, modify, amend, or delete your user account on our application at any time. 18. Data Processing Addendum (DPA)

This Data Processing Addendum (“DPA”) forms part of the agreement between Apps Leisure Ltd (the “Data Processor”) and the business client (the “Data Controller”) and governs the processing of personal data by Apps Leisure on behalf of the Data Controller.

18.1 Scope and Purpose of Processing

Apps Leisure processes personal data solely for the purpose of providing the platform services to the Data Controller, including but not limited to: hosting and managing the white-label application, facilitating user account management, enabling member communications and interactions, providing analytics and reporting, and processing payments through authorised third-party payment providers.

18.2 Categories of Data Processed

  • Business owner contact details (name, email, phone, address)
  • Member personal data (name, email, age, gender, sporting interests)
  • Usage and interaction data (login activity, feature usage, match history)
  • Payment and billing information (processed via Stripe and PayPal — Apps Leisure does not store full payment card details)
  • Device and browser information (IP address, browser type, operating system)

18.3 Obligations of the Data Processor

Apps Leisure, as the Data Processor, shall:

  • Process personal data only on documented instructions from the Data Controller, unless required to do so by applicable law.
  • Ensure that persons authorised to process personal data have committed themselves to confidentiality or are under an appropriate statutory obligation of confidentiality.
  • Implement appropriate technical and organisational measures to ensure a level of security appropriate to the risk, including encryption of data in transit, access controls, regular security assessments, and secure data storage.
  • Not engage another processor (sub-processor) without prior written authorisation of the Data Controller. Where general written authorisation has been given, Apps Leisure shall inform the Data Controller of any intended changes concerning the addition or replacement of sub-processors, giving the Data Controller the opportunity to object.
  • Assist the Data Controller in fulfilling its obligations to respond to data subject requests under the UK GDPR.
  • Make available to the Data Controller all information necessary to demonstrate compliance with these obligations and allow for audits and inspections.

18.4 Sub-Processors

Apps Leisure currently uses the following sub-processors in the delivery of its services:

  • Stripe — Payment processing
  • PayPal — Payment processing
  • Cloud hosting providers — Infrastructure and data storage

All sub-processors are contractually bound to maintain equivalent data protection standards and process data only in accordance with our instructions.

18.5 Data Breach Notification

In the event of a personal data breach, Apps Leisure shall notify the Data Controller without undue delay and in any event within 72 hours of becoming aware of the breach. The notification shall include:

  • A description of the nature of the personal data breach, including the categories and approximate number of data subjects and records concerned
  • The name and contact details of the point of contact where more information can be obtained
  • A description of the likely consequences of the breach
  • A description of the measures taken or proposed to address the breach, including measures to mitigate its possible adverse effects

18.6 Data Deletion and Return

Upon termination of the service agreement or upon request of the Data Controller, Apps Leisure shall, at the choice of the Data Controller, delete or return all personal data processed on behalf of the Data Controller. Following account closure, all data will be retained for 60 days to allow for account recovery, after which it will be permanently and irreversibly deleted from all systems, including backups and archives.

18.7 International Data Transfers

Where processing involves the transfer of personal data outside the United Kingdom, Apps Leisure shall ensure compliance with the requirements set out in Section 10 (International Transfers) of this Privacy Policy, including the use of Standard Contractual Clauses where no adequacy decision exists.
